Gabriele Ruscalla brings 15 years of experience handling complex international commercial and investment arbitrations governed by laws of European, Middle Eastern and African jurisdictions.
He represents corporations, States and state entities in construction, energy and mining, and corporate matters, and has extensive experience under the major arbitration rules (ICC, ICSID, LCIA, SIAC, UNCITRAL, CCJA, among others).
In the construction and energy sectors, Gabriele represents clients in cases concerning major infrastructure projects in the Middle East and Africa, involving complex and technical issues.
Gabriele also serves as arbitrator.
Before national courts, Gabriele represents his clients in arbitration-related litigation.
Gabriele worked as Counsel at the ICC International Court of Arbitration’s Secretariat from 2015 to 2021.
Experience as counsel
Experience in commercial arbitration
- In his former firm, Gabriele advised and represented a Middle Eastern company in an emergency arbitration, followed by a multiparty ICC arbitration related to the construction of a gas processing plant in Algeria. The proceedings were conducted in French, seated in Paris, and Algerian law applied.
- In his former firm, Gabriele advised and represented a European company in an ICC arbitration concerning a corporate dispute over the calculation of the management fees for the operation of a chemical plant. The proceedings were conducted in English, seated in Paris, and Belgian law applied.
- In his former firm, Gabriele advised and represented three Qatari companies in an ICC arbitration related to an infrastructure project in Qatar. The proceedings were conducted in English, seated in Doha, and Qatari law applied.
- In his former firm, Gabriele advised and represented two companies from the Middle East in an LCIA arbitration over a major banking dispute. The proceedings were conducted in English, seated in Abu Dhabi, and UAE law applied.
- In his former firm, Gabriele advised and represented a Congolese company (DRC) in a CCJA arbitration concerning the breach of agency contracts. The proceedings were conducted in French, seated in Abidjan, and DRC law applied.
- In his former firm, Gabriele advised and represented a Kuwaiti company in a multiparty ICC arbitration concerning the construction of an oil processing plant in Kuwait. The proceedings were conducted in English, seated in Geneva, and Kuwaiti law applied.
- In his former firm, Gabriele advised and represented a French company in an AFA arbitration involving a gas price review claim and the interpretation of the price review provision and the respective scopes of the arbitration and the expert determination proceedings. The proceedings were conducted in French, seated in Paris, and French law applied.
Experience in investment arbitration
- In his former firm, Gabriele advised a Middle Eastern corporation concerning a potential investment arbitration against an African state following the Arab spring.
- In his former firm, Gabriele was member of the team representing the People’s Democratic Republic of Algeria in ICSID proceedings (ICSID Case No. ARB/12/35) and parallel UNCITRAL proceedings.
- In his former firm, Gabriele was member of the team representing Caravelí Cotaruse Trasmisora de Energía S.A.C. against the Republic of Peru (ICSID Case No. ARB/11/9).
Experience before national courts
- In his former firm, Gabriele advised a European company and its Congolese subsidiary (DRC) in a multi-jurisdictional enforcement procedure of an NAI arbitral award.
- In his former firm, Gabriele advised and represented an Italian company in an annulment action of an ICC award before the Paris Court of Appeal’s International Commercial Chamber.
Sanctions
- In his former firm, Gabriele advised a multinational corporation on the application of EU sanctions against Russia to transit of raw materials from a non-sanctioned state to Europe via Russian territory.
- In his former firm, Gabriele advised foreign investors for the recovery of assets of sovereign States subject to EU/UN sanctions.
Experience as arbitrator
- Sole arbitrator in an ICC arbitration between a Spanish and a French company concerning the allegedly unlawful termination of an agency contract. The proceedings are conducted in French, seated in Paris, and French law applies.
- Sole arbitrator in a case under the Chamber of Commerce of Milan’s Rules (CAM) between two Italian companies concerning the alleged termination of a engineering contract. The proceedings are conducted in English, seated in Milan, and Italian law applies.
- Sole arbitrator in a case under the Swiss Arbitration Centre’s Rules between an American and a Swiss company concerning the alleged termination of a technology equipment sales contract. The proceedings were conducted in Italian, seated in Lugano, and Swiss law and the CISG applied.
- Co-arbitrator in an ad hoc arbitration between an Italian and a French company concerning the alleged termination of an agency contract. The proceedings were conducted in French, seated in Paris, and French law applied.
